You represent and warrant that:

Do:

  • Support Tree Fresno's mission of environmental stewardship

To the fullest extent permitted by law, Tree Fresno, its board members, staff, volunteers, and agents shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, loss of data, or business interruption, arising from:

In no case shall Tree Fresno's total liability exceed $100.

  • Refund policy: Donations are generally non-refundable. Requests for refunds should be submitted in writing to info@treefresno.org within 30 days of donation.

  • Recurring donations: If you set up a recurring donation, you may cancel at any time by contacting us or through your payment processor.

VOLUNTEER DISCLAIMERS

  • Assumption of risk: Volunteering with Tree Fresno may involve physical activity and outdoor work. You assume all risks associated with volunteering.

  • No employment relationship: Volunteers are not employees. Volunteering does not create an employment relationship, health insurance coverage, or other employment benefits.

  • Background checks: Tree Fresno may conduct background checks for certain volunteer positions, particularly those involving children or vulnerable populations.

  • Safety: You agree to follow all safety guidelines, wear appropriate protective equipment, and report hazards immediately.

7. Indemnification

You agree to indemnify, defend, and hold harmless Tree Fresno, its board, staff, volunteers, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Fresno County, California. You consent to the personal jurisdiction and venue of such courts.

11. Dispute Resolution

Informal Resolution: Before pursuing formal legal action, we encourage you to contact us at info@treefresno.org to resolve any dispute informally.

Binding Arbitration: If informal resolution is unsuccessful, you agree that any dispute shall be resolved through binding arbitration administered by a mutually agreed-upon neutral arbitrator, in Fresno, California.

Exceptions: Disputes regarding intellectual property infringement or unauthorized access to the Website may be brought to court without arbitration.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tree Fresno regarding your use of the Website and supersede all prior agreements and understandings.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

14. Waiver

The failure of Tree Fresno to enforce any right or provision in these Terms does not constitute a waiver of that right or provision. Tree Fresno's waiver of any breach does not constitute a waiver of any subsequent breach.

16. Special Notices for Nonprofit Users

Nonprofit Mission: Tree Fresno is a 501(c)(3) nonprofit organization dedicated to growing and protecting the urban forest in Fresno and the San Joaquin Valley.

Educational Use: Educational institutions and nonprofit organizations may request permission to use Tree Fresno content for educational and nonprofit purposes. Contact us at info@treefresno.org.

Media & Press: Journalists and media professionals may republish content with proper attribution. For high-resolution images or additional press materials, contact us.

Charitable Giving: These Terms do not affect your legal rights as a donor. Your donation is a voluntary gift to support Tree Fresno's mission.
